These Terms and Conditions govern all purchases made through the website www.chollopiscinas.com. By placing an order through our online store, the user fully accepts these Terms and Conditions, and we therefore recommend reading them carefully before completing any purchase.
In accordance with Article 97(1) of Royal Legislative Decree 1/2007 of 16 November, approving the revised text of the General Act for the Protection of Consumers and Users (Spanish Consumer Protection Act (TRLGDCU)), the following identifying details of the seller are provided:
These Terms and Conditions apply to all purchases made through the website www.chollopiscinas.com.
The user declares that they are over 18 years of age and have the necessary legal capacity to enter into contracts, in accordance with applicable legislation. If acting on behalf of a legal entity, the user declares that they have sufficient authority to do so.
Placing an order through the website constitutes express and full acceptance of these Terms and Conditions as published at the time the order is placed.
The language of the contract is Spanish. These Terms and Conditions are also available in English, French, Italian and Portuguese. In the event of any discrepancy between versions, the Spanish version shall prevail.
In accordance with Article 27 of Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (Spanish E-Commerce Act (LSSI-CE)), the service provider is required to provide clear, comprehensible and unambiguous information, prior to the commencement of the contracting process, about the various steps required to conclude the contract.
CholloPiscinas strives to describe the products offered on the website as faithfully and accurately as possible. However, colour variations may exist between the product image displayed on screen and the actual product, due to the user's monitor or device settings.
All prices shown on the website include Value Added Tax (VAT) at the current rate of 21%, unless expressly stated otherwise. Any applicable shipping costs will be communicated to the user before order confirmation.
Product prices may be modified at any time without prior notice. However, price changes will not affect orders already confirmed by the user.
In the event of a manifest pricing error (for example, a price significantly below the market price due to a typographical or technical error), CholloPiscinas will contact the customer to inform them of the error and offer them the option to confirm the order at the correct price or cancel it with a full refund of the amount paid.
The purchase process at CholloPiscinas is carried out simply and securely through the following steps:
The contract is formed when the user receives order confirmation by email, in accordance with Articles 23 to 28 of the Spanish E-Commerce Act (LSSI-CE).
CholloPiscinas reserves the right to reject an order if there are indications of fraud, incorrect or incomplete data, or any other circumstance that prevents the order from being properly processed. In such cases, the user will be notified and a full refund of the amount paid will be issued.

All transactions are carried out via secure SSL-encrypted connections and comply with PCI DSS security standards, ensuring maximum protection of the user's financial data.
The charge to the user's account will be processed at the time the order is confirmed.
CholloPiscinas does not store or have access to the user's credit or debit card details. This data is managed entirely by Redsys (CaixaBank virtual POS), which acts as an independent, certified payment processor.
The shipping and delivery conditions for orders placed through CholloPiscinas are as follows:
The customer must verify the condition of the packaging and the product at the time of delivery. If the packaging shows visible damage or signs of tampering, it is recommended to note this on the delivery receipt and notify CholloPiscinas within a maximum of 24 hours at info@chollopiscinas.com.
In the event of a delivery delay beyond the estimated time, the customer may set a reasonable additional period for delivery. If the product is not delivered within that additional period, the customer shall have the right to cancel the order and obtain a full refund of the amount paid, including shipping costs, in accordance with Article 66 bis of the Spanish Consumer Protection Act (TRLGDCU).
In accordance with Articles 102 to 108 of Royal Legislative Decree 1/2007 (Spanish Consumer Protection Act (TRLGDCU)), a user who qualifies as a consumer has the right to withdraw from the purchase contract within 14 calendar days of receiving the product, without having to justify their decision and without any penalty.
To exercise the right of withdrawal, the user must communicate their decision unambiguously by sending an email to info@chollopiscinas.com, stating their order number and their wish to withdraw from the contract. They may also use the model withdrawal form included below, although its use is not mandatory.
The refund of the amount paid will be processed within a maximum of 14 calendar days from the date on which CholloPiscinas is informed of the user's decision to withdraw.
Initial shipping costs will be refunded, provided they correspond to the cheapest standard shipping method offered. If the user expressly chose a shipping method other than the least expensive standard option, the difference between the cost of the chosen shipping and the standard shipping will not be refunded.
The cost of return shipping shall be borne by the customer.
The product must be returned in its original condition, unused, in its original packaging and with all accessories, labels and documentation included. Any reduction in the value of the product resulting from handling beyond what is necessary to check its nature, characteristics or functioning may be deducted from the refund amount.
Model withdrawal form (in accordance with Annex B of Royal Legislative Decree 1/2007):

CholloPiscinas will inform the user, before the order is placed, if any of the selected products fall within the exceptions to the right of withdrawal.
For a return to be accepted, the product must meet the following conditions:
The refund will be processed within a maximum of 14 calendar days from receipt of the returned product at our premises.
The refund will be made using the same payment method used by the user in the original purchase. No additional charges will be applied to the user as a result of the refund.
CholloPiscinas may withhold the refund until it has received the returned product, or until the user provides proof of return (for example, proof of postage), whichever occurs first.
All new products purchased through CholloPiscinas carry a 3-year legal guarantee from the date of delivery, in accordance with Directive (EU) 2019/771 of the European Parliament and of the Council of 20 May 2019, transposed into Spanish law by Royal Decree-Law 7/2021.
In the event of a lack of conformity of the product, the consumer is entitled to the following remedies, in accordance with Articles 114 to 127 of the Spanish Consumer Protection Act (TRLGDCU):
During the first 2 years from delivery, it will be presumed that any lack of conformity that becomes apparent existed at the time of delivery, with the burden of proof resting on the seller to demonstrate otherwise. From the second year up to the third year, it will be for the consumer to demonstrate that the lack of conformity already existed at the time of delivery.

Furthermore, in accordance with Regulation (EU) 524/2013 of the European Parliament and of the Council of 21 May 2013, we inform users of the existence of the European Union Online Dispute Resolution platform, accessible at: https://ec.europa.eu/consumers/odr. This platform allows consumers and traders to resolve disputes arising from online purchases out of court.
CholloPiscinas is committed to the amicable resolution of any dispute that may arise with its customers, prioritising dialogue and the search for mutually satisfactory solutions before resorting to legal proceedings.
These Terms and Conditions are governed by Spanish law, in particular by Law 34/2002 on Information Society Services and Electronic Commerce (Spanish E-Commerce Act (LSSI-CE)), Royal Legislative Decree 1/2007 approving the revised text of the General Act for the Protection of Consumers and Users (Spanish Consumer Protection Act (TRLGDCU)), and other applicable legislation.
For users who qualify as consumers or users, the competent Courts and Tribunals shall be those of the consumer's place of domicile, in accordance with applicable legislation.
For users acting as traders or professionals, both parties submit, expressly waiving any other jurisdiction, to the Courts and Tribunals of Santander.
In accordance with Article 26 of Law 34/2002 (Spanish E-Commerce Act (LSSI-CE)), contracts concluded electronically shall produce all the effects provided for by law when consent and the other requisites necessary for their validity are present.
